OUC RANDOM ACTS OF GREENNESS VIDEO CONTEST
OFFICIAL RULES & REGULATIONS
CONTESTANT ELIGIBILITY
- The person (“You or you”) submitting a video (“Entry”) for the Random Acts of Greenness contest (the “Contest”) and any other individual(s) included in the Entry (“Team Member(s)”) must meet the eligibility standards included in this document titled Random Acts of Greenness Contest Official Rules (the “Official Rules”). You and Team Members (if any) must comply with the Official Rules.
- You and each Team Member, if applicable, must be at least 18 years of age, as of the date You submit the Entry. If You or any Team Member(s) is/are under 18 years of age on the date You submit the Entry, You and each said Team Member(s) must have written consent from each of said person’s respective parent or legal guardian. You and each Team Member must be a legal resident of the State of Florida.
- Contest will be open for Entry submission from April 22, 2011, to June 1, 2011. All Entries must be received by 5:00pm EST on June 1, 2011.
- Entry voting will be open from April 22, 2011, to June 12, 2011. All votes must be placed before 5:00pm EST on June 12, 2011.
- To submit an Entry, You must create a Personal YouTube Account and upload the Entry to that account. No direct video uploads will be accepted on the Contest website. Once the video has been uploaded, generate a link through YouTube to the Entry location. Visit www.oucrandomactsofgreenness.com and click on the Contest Entry Section. Complete the Entry Form, filling in all required data and submit the YouTube link in the section provided.
- Employees or immediate family of employees of the Orlando Utilities Commission (“OUC”), the City of Orlando or its agencies are not eligible to submit an Entry.
- If You or any Team member(s) are currently under contract with a third party that would conflict with any aspect of this Contest, You or said Team Member(s) are prohibited from entering into the Contest.
VIDEO CONTENT
- Your Entry should highlight the importance of energy and/or water conservation and/or how it impacts our environment, our children and our quality of life.
- The Entry must spotlight a simple act that someone can do in their everyday life that will help conserve energy and/or water.
- Your Entry must be suitable for all audiences and should contain acceptable content and language for viewing in a Television Commercial, or via any other media, in OUC’s sole discretion.
- Your Entry must be no more than 30 seconds in length and must adhere to all YouTube file size and type restrictions. Full YouTube file specifications can be found at www.youtube.com/t/about_essentials#upload.
- These Official Rules apply to You and all all Team Member(s). Your Entry must be original and owned by You or, in the case of group entries, by You and the Team Member(s). The individual who submits the Entry will be designated the Team Leader, and all additional names submitted with the Entry will be deemed the Team Member(s).
- You may not submit any video previously used in any other competition, or that has been previously published or won any award. Your video may only be submitted once. In the event the same video is submitted by more than one person, only the first Entry received will be accepted and all additional duplicate Entries will be disqualified.
- Your Entry cannot:
- contain any profanity, inappropriate or explicit language;
- demonstrate any lewd or sexually suggestive gestures or contain any nudity, drug or alcoholic beverage use;
- engage in any unsafe behavior or any other representation deemed inappropriate by OUC;
- defame, invade privacy, abuse, threaten, harass, or use obscene or offensive language towards a third party or OUC;
- infringe on any intellectual property or other right of any person or entity (by way of example, including but not limited to, anyone appearing in the video wearing branded merchandise with any brand logo);
- falsify or delete author attributions, legal notices, or other proprietary designations;
- use copyright-protected material (including music) unless given express written permission from the copyright holder that must be properly assigned to OUC in order to have an eligible and qualified video;
- violate any law or advocate illegal activity;
- knowingly contain viruses, corrupted files, or other materials that may cause damage to any computer system
- If any other individual appears in the Entry, You must submit signed originals of the following documents: Official Rules (all participants may sign the same form in the provided space on said document), the Waiver and Release Form, and the Copyright Permission Form (jointly all said forms will be referred to as the “Waiver Packet”) for each said individual appearing (or the individual’s parent or legal guardian, if the individual is a minor) and provide the said forms with your Entry as provided in the Official Rules.
SUBMISSION RULES
- To submit an Entry, You must first create a YouTube Account and upload Your video to Your personal account. Using YouTube, generate a link to Your Entry. Visit www.oucrandomactsofgreenness.com and click on the Contest Entry Section. Fill out the required information and insert Your link in the appropriate section. Note: Entries that do not have all required information filled out appropriately and completely at the time of submission will not be accepted.
- After the Entry is submitted, a message will be generated confirming successful submission and provide a link to the Waiver Packet.
- If You and/or Team Member(s) have a part in the Entry, the Team Leader will be the point of contact for all matters pertaining to the Contest.
- Entries must include a valid e-mail address for the Team Leader.
- The Waiver Packet must be complete and include the information requested for You and all Team Member(s).
- Each individual who has a part in Your Entry is required to fill out the applicable forms in the Waiver Packet and the Team Leader must submit a completed Waiver Packet associated with the Entry.
- Scanned or Faxed Copies of the original signed forms included in the Waiver Packet will be accepted.
- Completed Waiver Packets must be submitted through any one of the following methods:

- Once an Entry has been submitted and the completed Waiver Packet has been received by OUC via the herein above specified means, OUC will review the submitted video and determine whether or not it meets the criteria as set forth in the Official Rules.
- The Orlando Utilities Commission reserves the right to disqualify any Entry that does not meet the Contest criteria.
- Entries that are approved as having met the Contest criteria will be posted to theOUC Facebook Page www.facebook.com/oucthereliableone.
- All qualified Entries will be posted within 72 hours of receiving ALL REQUIRED ENTRY MATERIAL.
- Once an Entry has been posted, the winner will be determined by the Entry that receives the most votes (“Likes”) from the day it is posted on the OUC Facebook Page until 5:00pm EST June 12, 2011.
- “Likes” will only be counted on the posting made on the OUC’s Facebook Page. No other votes from any additional websites will be included.
- To be eligible for the Contest, Your Entry and all related documentation must be received by 5:00 pm EST on June 1, 2011.
- File size and content must adhere to the Terms and Conditions as set forth by YouTube that can be found at www.youtube.com/t/terms.
- In accordance with all the terms and conditions of the Official Rules, after submitting your Entry You must submit the following:
- Copy of the Official Rules signed by You and any person claiming a part of the video submitted as the Entry. If You or any person claiming a part of the video submitted as the Entry are under 18, Your parent or legal guardian must sign for You. If any person included in Your Entry is under 18, the parent or legal guardian of any such person under 18 must sign for that person(s).
- Signed Waiver and Release Form for every individual claiming a part of the video submitted as the Entry.
- Signed Copyright Permission Form for every individual claiming a part of the video submitted as the Entry.
- There is no fee to enter this Contest.
- The OUC will not return any Entries.
- The OUC will ask the winner to provide a copy of their original video used for the Entry prior to distributing prizes. Accordingly, You should keep a copy in the original format.
- The OUC will not be responsible for lost, late, misdirected, damaged submissions or attempted submissions, or for e-mail, internet, computer hardware and software, phone, and/or any other technical errors, malfunctions, and delays that may prevent You from uploading Your video into the competition, or interfere with Your compliance with the rules of this competition. All responsibilities related to submitting a qualifying entry remain with You at all relevant times.
- The OUC will not be responsible for any interference, malfunctions, and/or delays that may occur as a result of technical errors experienced by Facebook or YouTube.
- The OUC is not required to host, display, accept, consider, or broadcast any video submitted if it is found to have violated any rule as set forth in the Official Rules or is in violation of any existing local, State or Federal rule, regulation, law, ordinance or is found to violate any existing policy of OUC. Furthermore, OUC reserves the right to end the contest at such time as it receives 1,000 Entries, even if said time is prior to the Contest end date stated in the Official Rules.
JUDGING AND SELECTION
- OUC will validate all Entries and will determine, at its sole discretion, whether each video meets the Entry criteria detailed herein for acceptance as an Entry into the Contest.
- OUC reserves the right to disqualify any Entry that does not comply with Contest rules.
- As the videos are intended for educational purposes, OUC reserves the right to ask You to correct the themes or information contained in Your Entry; however, OUC is not required to do so, and may consider inaccuracy of the theme or information contained within the Entry as a factor in disqualification. If you are asked to correct your Entry, you will be given a reasonable time to do so. If corrections are not made within the allotted time, the Entry will be disqualified.
- OUC reserves the right to notify You and/or any Team Member concerning errors or missing pages from the Waiver Packet submission; however, OUC is not required to do so, and may consider missing or incorrectly submitted Waiver Packet information as grounds for disqualification.
- OUC will validate all entries and will determine, at its sole discretion, whether each entry meets the qualification criteria, as stated herein, for acceptance into the Contest. OUC will not be involved in the final judging of contest entries.
- A Contest winner will be chosen by popular vote, number of Likes, of the Entry as posted on Facebook by OUC.
- If there are no Entries that can be validated as pertaining to educational purposes or otherwise qualified, no prizes will be awarded.
- Should a winning Entry belong to You as the Team Leader for an Entry where there are Team Member(s), You will be awarded the prize as the Team Leader. Any sharing of the prize is between You and the each of the other Team Member(s), and OUC assumes no responsibility for prize distribution to Team Member(s), nor will it become involved in disputes among the Team Member(s).
PRIZES
- OUC will professionally produce the winning Entry into a professional Television Commercial. This Commercial will be used on ouc.com and will be aired as part of OUC’s fall broadcast Television Campaign.
- You and any of the Team Members will be allowed to participate in the filming of OUC’s version of the winning Entry.
- You and any of the Team Members will be offered the chance to appear in the final version of the Television Commercial.
- OUC, in its sole discretion, will reserve final decision-making authority regarding who appears in the Television Commercial and how the Television Commercial is produced; and OUC will use a designated OUC vendor, in its sole discretion, to produce the Television Commercial. OUC reserves the right, in its sole discretion, to perform a criminal background check on any individual who will appear in the Television Commercial.
NOTIFICATION
- You will be notified via e-mail to the address provided on the submission form submitted with Your Entry and must respond within ten (10) business days.
- In order to receive the prize, You and each of the Team Members (if applicable) must submit a copy of the original Entry, and any additional documentation required by OUC within fourteen (14) days of response to the initial notification.
- Failure to return all requested documents within the set forth time, or to comply with any term or condition of the rules or prize notification, may, in the sole discretion of the OUC, result in Your Entry’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate Entry.
OTHER RULES
- You and the Team Member(s) understand and acknowledge and agree that once an Entry is submitted, You and the Team Member(s) shall have no right to prohibit, restrict, revoke or terminate any of the rights granted to OUC hereunder.
- You and the Team Member(s) understand and acknowledge that You and the Team Member(s) are not entitled to any compensation or other consideration for Your video Entry or any use made of said video once submitted into the Contest.
- By entering the Contest, You and each of the Team Member(s) agree to indemnify and hold harmless OUC, its officers, employees, representatives, and agents, from any claims, damages, and expenses (including reasonable attorneys’ fees and related disbursements) arising from or related to the Entry and/or Your or any of the Team Member’s participation in the Contest, including but not limited to any claims, damages, and expenses arising from or related to Your and/or any of the Team Member’s actual or alleged infringement or violation of any patent, copyright, trademark, or other proprietary right.
- By submitting your Entry into this Contest, You and the Team Member(s) hereby grant to OUC the royalty-free nonexclusive right to copy, sublicense, edit, modify, publish, transmit, make derivative works, distribute, delete or display the content of the video and elements embodied within the video (submitted as the Entry), in whole or in part, worldwide, in any media including television broadcast and via Internet download, streaming, transmission, exhibition or distribution physically or by any computer-mediated networked communication systems, whether now existing or later invented in perpetuity, without limitation and without consideration or acknowledgment to the entrant, including for advertising/publicity purposes without compensation, except where prohibited by law. You and the Team Member(s) understand however, that OUC is not assuming any obligation hereunder to broadcast or distribute any Entry submitted into the Contest.
- By submitting an Entry, You and the Team Member(s) grant OUC the right to use and authorize others to use information provided by You and/or the Team Member(s) to the OUC hereunder, including but not limited to Your name and city of origin, as well as excerpts from your submission(s) and the names, voices, likenesses, and biographies of all persons performing services in connection with the video in any media, as news or information for advertising, educational, trade and promotional purposes, and for other purposes by or for the benefit of OUC.
- You agree to be bound by the Judging and Selection guidelines as set forth in the Official Rules and to comply with all federal, state, and local laws, rules, ordinances and regulations as well as all Terms and Conditions as set forth by YouTube.
- OUC reserves the right, in its sole discretion, to cancel or terminate the Contest and to select winners from among eligible Entries legitimately received prior to the event causing cancellation or termination.
